- Purpose
Jimmy Proximity Inc. (the “Corporation”) recognizes the importance of protecting the privacy of all Personal Information (as hereinafter defined) provided by users of its web site located at http://www.RELABmusic.com (the “Site”). This Privacy Policy sets out the rules that the Corporation follows in connection with the collection, use, disclosure, retention and access to Personal Information of its users.
The purpose of this Policy is to provide principles for the management of Personal Information in a manner that acknowledges both the right of individuals to protect their Personal Information and the need for the Corporation to collect, use and/or disclose Personal Information in the course of providing services to its users.
The Corporation is sensitive to the confidential nature of the Personal Information collected from its users and recognizes the need for appropriate protection and management of Personal Information provided to the Corporation.
This Privacy Policy applies to the Site only and does not cover information collected on any third party site to which this Site links.
- Definitions
For the purposes of this Privacy Policy, the following terms shall have the following meaning:
- “Personal Information” means any information which relates to a natural person and allows that person to be identified, including but not limited to, his or her name, postal address, email address, telephone number or credit card number, as the case may be;
- “collect” means to lawfully gather, receive or record Personal Information from any source and by any method;
- “disclose” means to make Personal Information available to, or known to someone outside of the Corporation; and
- “use” means the management of Personal Information by the Corporation for any purpose.
- Collection and Use of Personal Information
When registering for an account, the Corporation will only collect the Personal Information that is necessary for the purposes identified in this Policy. The Personal Information which will be collected through the registration process is as follows:
- Screen name. It will be made public on the Site. There is no need for such screen name to have any relation to the user’s actual name.
- Email address.
- Password for the user’s account.
Other non-identifying information such as, gender, date of birth and postal code may be provided by the user but is not required for the use of our Services.
The information you provide us will be used solely for statistic purposes and providing our services to users, which services will include customized content and advertisement.
When registering for an account, the user will be invited to “opt in” to receive a regular newsletter or occasional email from the Site, and will be free to “opt out” from either of these services at any point in the future.
If we are to use the Personal Information you have provided in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.
You can decline to submit Personal Information to our services, in which case, the Corporation may not be able to provide its full services to you as most information requested leads to improved personal performance of our services.
Should you cancel your account with the Corporation in accordance with the Terms and Conditions of Use, the Corporation will immediately cease to use and delete from its systems all your Personal Information except to the extent that it forms part of the statistics or other general information available generally to other users of the Site, unless it is required by law to maintain all or part of your Personal Information for a certain period of time or unless you have expressly consented to the Corporation continuing to use your Personal Information for purposes identified upon obtaining your consent.
- Disclosure
We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and /or comply with a judicial proceeding, court order, or legal process served on our Site.
We may share information (such as demographic information) with our partners and advertisers, for purposes including, but not limited to, the delivery of targeted advertising. This information will not be linked to any Personal Information that can identify any natural person.
If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s name and email address. We will automatically send the friend a one-time email invitation to visit the site, and may send one follow-up invitation to friends that did not respond. We store this information for the sole purpose of sending these emails. The friend may contact us at [●] to request the removal of this information from our database.
- Information Security and Confidentiality
We protect the confidentiality of your Personal Information by taking all necessary measures to prevent unauthorized access to or unauthorized alteration, disclosure or destruction of data. These measures include encryption of passwords, internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data
We restrict access to Personal Information to our employees who need to know the information in order to operate, develop or improve our services or for whom such information is necessary to the performance of their functions and duties. All employees of the Corporation are bound by confidentiality obligations.
- Beta Version of Site
RELABmusic.com is (currently) “Beta” software. While the Corporation strives to maintain all of the above privacy precautions, RELABmusic.com is not devoid of risk of “bugs” and software faultiness that is common with Beta software. As is made clear in the Terms of Service regarding, the Corporation disclaims and limits its liability with respect to such “Beta” software, including limitation of its any liability regarding privacy issues set forth in this policy.
- Links
This Privacy Policy applies to the Site only. Our Site contains links to other sites and the Corporation is not responsible for the privacy practices or content of such other sites. We encourage you to read the privacy policy of each Site to which you may link through our Site that may collect Personal Information.
- Access to and Update of your Personal Information
You may access and consult the Personal Information you have provided us at all times. The Site offers all necessary tools in order for you to correct your Personal Information if it is inaccurate or to delete such information at your discretion. You may also request that the Corporation delete all your Personal Information from its servers by sending an email request to privacy@jimmyproximity.com . The Corporation will delete your Personal Information provided it is not required by law to retain such information or for legitimate business purposes. It is your responsibility to ensure that all your Personal Information is accurate and the Corporation will not be liable for any loss, damage or claim arising out of the use of inaccurate information.
In certain circumstances, the Corporation may not provide access to all or part of the Personal Information requested, for example, where disclosure would reveal confidential commercial information, where the information was collected for the purpose of an investigation, where the information may have effect on pending or foreseeable proceedings, where the information is protected by solicitor client privilege, where disclosure would threaten the safety or health of an individual, or where disclosure would reveal Personal Information about another individual.
In the event that the Corporation cannot provide access to Personal Information, it will inform the user, of the reasons why, subject to any legal or regulatory restrictions and it will provide the employee with any recourse available, such as the right to have the decision reviewed by the appropriate legal body within any prescribed time limit.
- Consent
Your express consent is necessary in order for the Corporation to collect, use and/or communicate your Personal Information. By registering for an account with the Corporation, you will be deemed having expressly consented to the collection, use and/or communication of your Personal Information in accordance with the terms hereof. If you do not agree with all or part of the terms of this Privacy Policy, you should not register for an account with the Corporation or cease to use its services.
WE DO NOT KNOWINGLY COLLECT or solicit personal INFORMATION from anyone under the age of 13 or knowingly allow such person to register. If you are under 13, please do not attempt to register for an account with the corporation or send any information about yourself to us, including your name, address, telephone number, or email address. no one under the age of 13 may provide any personal information to or on the site. in the event that we learn that we have collected personal information from someone under the age of 13 without verification of parental consent, we will delete that information as quickly as possible. if you believe that we might have information from or about a child under 13, please contact us at privacy@jimmyproximity.com. We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the internet.
- Cookies
A cookie is a small data file that a Site transfers to a user’s hard drive when a user visits the Site. A cookie can contain information such as IP addresses or user ID that the Site uses to remember user names for quicker login and passwords to keep users logged in. The only Personal Information a cookie can contain is that which a user supplies. A cookie cannot read data off a hard disk or read cookie files created by other sites.
The Corporation does not use cookies to store any other Personal Information about a user. We may, however, use cookies to log IP addresses. We use this information to analyze trends, administer the site, and gather broad demographic information for aggregate use and advise our partners of same. The information we collect does not contain anything that can identify users personally. The Corporation does not have control over cookies placed on a user’s hard drive by advertisers.
You can delete cookies from your hard drive or reset your browser to refuse all cookies or to indicate when a cookie is being sent.
- Changes to this Policy and Governing Law
The Corporation may amend this Privacy Policy at any time. If any material changes are made, we will notify you by sending an email to the email address you have provided us and/or by posting a notice on the Site’s homepage. Should the changes reduce in any your rights under this Privacy Policy, we will request your consent prior to the implementation of the changes and you will be provided with the possibility to opt-out of the use of your Personal Information.
You agree that this Privacy Policy is and the use and storage of Personal Information by the Corporation will be governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
